Terms of Service

These terms are an agreement between you and When ("we", "us"), the operator of whentiming.com and the When app (together, "the service"). By using the service you agree to them. If you do not agree, do not use the service.

The service

When provides general wellness and educational timing guidance: suggested times for waking, caffeine, wind-down and bed, built from the answers you give. It is not a medical service or device and does not diagnose, treat, cure or prevent any condition. Read the wellness disclaimer at https://whentiming.com/disclaimer; it is part of these terms.

Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the service.

Accounts

You can use the service without an account. If you save your plan, you are responsible for the email address you use and for activity under it. Sign-in uses one-time links and codes rather than a password; do not share a code with anyone.

Subscriptions, trials and renewals

Parts of the service require a paid subscription: an annual plan, which may include a free trial, and a monthly plan. The price, billing period, trial length (if any) and the date of the first charge are shown before you confirm a purchase.

Subscriptions renew automatically at the end of each period until cancelled. You can cancel at any time: web subscriptions in the billing portal linked from the app and the web, App Store subscriptions in your Apple ID settings, Google Play subscriptions in the Play Store. Cancellation stops future renewals; access continues until the end of the period already paid for.

Purchases made through the App Store or Google Play are also subject to that store's terms, and refunds for those purchases are handled by the store under its policy. For web purchases, contact us; we honour refunds required by applicable law and consider other requests case by case.

Prices may change; we will tell you in advance and you can cancel before the new price applies. Taxes may be added where required.

Acceptable use

Do not misuse the service: no attempts to breach security, scrape, overload or reverse engineer it, no use for unlawful purposes, and no sharing of sign-in codes. We may suspend or end access that breaks these rules.

Our content

The service, its design, text, audio, software and the plan engine belong to us or our licensors. You get a personal, non-transferable licence to use the service for your own use. Your own answers and check-ins remain yours; you give us a licence to process them to provide the service, as described in the privacy policy.

No warranties

The service is provided "as is" and "as available". To the fullest extent permitted by law we make no warranties, express or implied, including fitness for a particular purpose, and we do not promise that the service will be uninterrupted or error free, or that following the plan will improve your sleep.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data or profits, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits; in that case they apply to the extent permitted.

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights.

Ending the agreement

You can stop using the service at any time and delete your account in Settings. We may suspend or end your access if you break these terms or if we discontinue the service, with notice where practical; if we end a paid subscription for a reason other than your breach, we refund the unused part of the period.

Governing law and disputes

These terms are governed by the laws of the United States and of the state in which When is established, without regard to conflict of law rules, except where your local consumer law gives you additional protection that cannot be excluded. Before starting any formal proceeding, contact support@whentiming.com so we can try to resolve the issue directly.

Changes

We may update these terms. Material changes are announced in the service or by email before they take effect; continuing to use the service after that date means you accept the new terms.
